New General Product Safety Regulation (GPSR) and its impact on Amazon and other marketplaces

July 8, 2024

Starting December 13, 2024, the new General Product Safety Regulation (GPSR) will come into effect, replacing the General Product Safety Directive and the EU directive on dangerous products resembling foodstuffs. This regulation will introduce new requirements for most non-food consumer products sold in the EU.

Note: it is important to note that the GPSR will not apply in Great Britain (England, Scotland, and Wales) but will be valid in Northern Ireland according to the Northern Ireland Protocol.

Effects of GPSR on Amazon and other marketplaces

The GPSR will introduce the obligation to provide and display safety information for most non-food consumer products sold in the EU, including marketplaces like Amazon. Amazon has already started contacting sellers and vendors to remind them to provide the new mandatory information.

Affected products and main requirements

The regulation covers most non-food consumer products sold in the EU, including used, repaired, and reconditioned products.

Three main requirements to meet:

  1. Responsible person requirements: non-food products must be labeled with the contact information of the Responsible Person, including postal and electronic addresses, in one of the official EU languages. This labeling can be attached to the product, its packaging, the parcel, or an accompanying document;
  2. Manufacturer information requirements: non-food products must be labeled with the contact information of the manufacturer and, if applicable, the importer. This labeling can be attached to the product, its packaging, or an accompanying document;
  3. Labeling and traceability requirements: products must be labeled with identifiers such as type, batch, or serial number for easy identification. Additionally, the product image and necessary information must be included in online listings. For information on the required warnings and safety information for your products, refer to the Product Compliance help pages.

What to do and next steps

From December 13, 2024, all offers must comply with the GPSR requirements. Amazon will remove non-compliant offers, which will not be eligible for flash sales. By this deadline, it will be necessary to:

  • Provide Amazon with the name and contact details of the responsible person and the manufacturer;
  • Display applicable warning and safety information on the product detail pages in the languages of the country of sale: this information can be an image, a product manual, or any other document containing the necessary details (the type of information to be uploaded varies based on the product category);
  • Enter the information of the responsible person or the manufacturer on Amazon.

Within Vendor Central and Seller Central, a section called "Manage your Compliance" has been added to input the contact details of the manufacturer and the Responsible Person at both brand and vendor code levels.

Product Safety Information (PSI)

Applicable warning and safety information must be displayed on the product detail pages in the languages of the country of sale. This information can be an image, a product manual, or any other document containing the required information (the documents accepted by Amazon and information on how to upload them can be found at this link for Vendor Central and at this link for Seller Central).

Witailer Tips

We advise regularly checking the "Product Certificates" section to verify if there are new documents to upload. Starting from August 2024, there may be a new section in Vendor Central that will allow bulk uploading of all documents.
